These Terms of Service ("Terms") govern your access to and use of flora-fire.com (the "Site") and any related products or services provided by Flora & Fire LLC ("Flora & Fire," "we," or "us"). By using the Site or placing an order, you agree to these Terms.

Flora & Fire LLC is a Florida limited liability company that grows premium Ecuadorian roses at our family farm in Cotopaxi, Ecuador, and ships them direct to customers in the United States.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to place an order. By using the Site, you confirm that you meet these requirements.

Orders

All product descriptions, prices, and availability on the Site are subject to change without notice. We reserve the right to refuse or cancel any order, including orders that appear fraudulent or violate these Terms. If we cancel your order, we'll notify you and refund any payment already made.

Pricing and payment

Prices on the Site are in US dollars and do not include shipping or applicable taxes, which are calculated at checkout. Payment is processed at the time you place your order through Shopify's payment infrastructure.

Shipping and delivery

Please see our Shipping Policy for shipping times, methods, and limitations. We ship only to addresses within the continental United States.

Returns and refunds

Because our roses are perishable and cut to order, we do not accept returns. For our refund and reshipment process, see our Refund Policy.

Subscriptions

Our subscription service ("Subscription") allows you to receive recurring deliveries of our roses on a cadence you select (biweekly or monthly). By starting a Subscription, you authorize us to charge your payment method on file for each delivery until you cancel or pause. You can cancel or pause your Subscription anytime from your account dashboard or by emailing hello@flora-fire.com. There is no lock-in period or cancellation fee.

Account

If you create an account, you are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us at hello@flora-fire.com if you suspect unauthorized use of your account.

Intellectual property

All content on the Site, including photography, text, logos, and the Flora & Fire brand identity, is owned by Flora & Fire LLC or used with permission. You may not reproduce, copy, modify, or distribute any part of the Site without our written consent, except as permitted by applicable law.

Acceptable use

You agree not to use the Site to violate any law, infringe anyone's rights, interfere with the Site's operation, or attempt to access areas of the Site you are not authorized to access.

Disclaimers and limitation of liability

The Site and our products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Flora & Fire disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. In no event will Flora & Fire be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Site or our products. Our total liability to you for any claim arising out of these Terms or our products will not exceed the amount you paid for the order in question.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of these Terms will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

We may update these Terms from time to time. The updated version will be posted on this page with a new "last updated" date.
